ModaScout Terms and Conditions

These Terms and Conditions (Terms) govern your download, access to, and use of the ModaScout mobile application, Share-to-App features, notifications, websites or support pages that link to these Terms, and related backend services (together, the Service).

Please read these Terms before using ModaScout. They contain important information about AI-generated clothing analysis, third-party product results, retailer links, acceptable use, account deletion, availability, and responsibility when something goes wrong.

1. Who provides ModaScout

The Service is provided by ModaScout Limited. ModaScout is our trading name and brand. In these Terms, ModaScout, we, us, and our mean ModaScout Limited.

2. Accepting these Terms

By selecting the control that records your agreement, or by creating or using a guest or registered account after these Terms have been presented to you, you agree to these Terms and acknowledge the Privacy Policy. Uploading or sharing an image, starting a scan or search, or continuing to use the Service after valid notice may also confirm your agreement where the law permits.

If you do not agree, do not use the Service. If you use ModaScout on behalf of an organisation, you confirm that you have authority to bind that organisation; in that case, you includes both you and the organisation where the context permits.

You must have a reasonable opportunity to read these Terms before being bound by them. Nothing in these Terms removes rights that cannot lawfully be excluded or limited.

3. Eligibility and children

You must be at least 18 years old to create or use a guest or registered account, upload or share an image, or otherwise use ModaScout. By using the Service, you confirm that you are 18 or older and legally capable of entering this agreement.

ModaScout is not directed to children. A parent or guardian who believes someone under 18 has used the Service should contact us. We may restrict or delete underage accounts and associated content as described in the Privacy Policy.

You must not misstate your age, allow someone under 18 to use your account, or help anyone bypass an age or eligibility control.

4. What ModaScout does

ModaScout lets you:

The Service is a discovery and search tool. ModaScout is not a retailer, marketplace, seller, manufacturer, payment processor, stylist, authenticator, or party to a transaction between you and a retailer unless we expressly tell you otherwise in a separate agreement.

5. Guest and registered accounts

5.1 Guest accounts

ModaScout may create a stable guest account associated with your installation. A guest account lets the Service associate scans, results, preferences, quotas, notifications, and Wardrobe items with the same user without requiring an email sign-up.

Guest access is not a guarantee of permanent recovery. If you lose the device, clear app data, lose the guest credentials, or uninstall without first converting the guest account, we may be unable to restore it even if some server-side data remains.

5.2 Registered accounts

You may create a registered account using accurate and current information. You are responsible for keeping your email account and ModaScout credentials secure and for activity conducted through your account. Tell us promptly if you suspect unauthorised access.

You must not create an account using another person's identity or email without authority. We may require email confirmation, session refresh, or identity verification for security-sensitive actions.

5.3 Guest-to-account transfer

When you register or sign in from a guest session, eligible guest scans and Wardrobe data may be transferred to the registered account. ModaScout uses durable ownership and deletion controls to avoid duplication or data resurrection. A cleanup retry may continue after sign-in without preventing access to the transferred account.

5.4 Account deletion

Registered users can request deletion through the account controls. Deletion removes the registered identity and associated operational data and private images, subject to the limited legal, security, consent, and deletion records described in the Privacy Policy.

After deletion, the app may create a new, separate guest session so it can continue to open. That new session is not a restoration of the deleted account. Deleting the app from your device does not itself submit an account-deletion request.

6. Third-party AI consent

ModaScout will not start a new scan requiring third-party AI unless the current account has given the separate consent shown in the app.

When you consent:

You may withdraw consent in ME. Without consent, ModaScout cannot process new scans. Withdrawal does not undo processing already completed and does not delete previous scans or results; use the scan or account deletion controls if you want those removed.

Consent is personal to the relevant account. You must not use someone else's account or device to bypass their consent choice.

7. Your photos and other content

7.1 Ownership

You keep any ownership rights you have in photos, screenshots, shared files, text, and other content you submit (User Content). These Terms do not transfer ownership of your User Content to ModaScout.

7.2 Permission to process User Content

You grant ModaScout a limited, non-exclusive, worldwide, royalty-free licence to host, copy, transmit, resize, crop, analyse, search with, cache, display to you, and otherwise process User Content only as reasonably necessary to:

This licence ends when the content is deleted from active systems, except to the limited extent it remains in protected backups, audit records, legal holds, or third-party processing already initiated as described in the Privacy Policy.

7.3 Your responsibilities for User Content

You confirm that you own User Content or have all permissions needed to upload, share, and process it through ModaScout. In particular:

ModaScout may reject, block, quarantine, or delete content where reasonably necessary for safety, security, legal compliance, or enforcement.

8. AI analysis is fallible

AI-generated analysis may be inaccurate, incomplete, inconsistent, or affected by image quality, lighting, occlusion, layering, text, brand visibility, or provider availability. ModaScout may miss clothing, identify the wrong garment, produce an imperfect crop or description, or infer an incorrect retail category.

Analysis is provided to support product discovery, not to identify a person or give professional advice. Do not rely on it for legal, medical, safety, authentication, valuation, counterfeit detection, body-image, employment, insurance, or other high-impact decisions.

You are responsible for reviewing the detected garments and choosing what to search.

9. Product search and result ordering

ModaScout uses third-party product-search results and its own filtering, deduplication, ranking, localisation, and image-recovery logic. Depending on the selected garment, the Service may run localised Google Lens Products and global-English Lens Exact concurrently. It may run one emergency Google Shopping fallback only where the existing search criteria permit it.

ModaScout does not guarantee:

Default relevance ordering and explicit price sorting are presentation tools, not endorsements. The All view may deduplicate the same product across garments and preserve its first occurrence rather than showing strict alternation.

10. Product and retailer information

Retailer and provider information may be inaccurate, incomplete, delayed, automatically generated, or changed after ModaScout retrieved it. Always verify on the retailer's site:

If a product image cannot be recovered, ModaScout may keep the product in its original rank and invite you to visit the retailer to view it. This does not mean the retailer or product has been verified.

Currency display is a convenience. Converted or localised amounts may be estimates and are not a binding quote.

Reference exchange-rate data is supplied by ExchangeRate-API. Currency symbols and conversions are provided for convenience and may not reflect the rate used by your bank, card provider, payment service, or retailer.

11. Retailer links and purchases

Retailer links take you to a third-party website or app. Your relationship and any purchase are directly with that retailer. The retailer's terms, privacy policy, payment terms, delivery, returns, warranties, and dispute process apply.

ModaScout does not currently process payment-card details or retailer purchases. We are not responsible for a retailer's content, products, omissions, availability, fulfilment, refunds, security, or conduct, except where applicable law makes us responsible.

ModaScout does not currently receive affiliate commission or other compensation from retailer links. We may introduce affiliate links later. Before doing so, we will update the relevant notices and clearly disclose the commercial relationship where required. Affiliate compensation will not permit us to misrepresent a product match or override the disclosed result-ordering logic.

12. Wardrobe and likes

A like is associated with a stable product identity and may appear across garment filters. Saving a product does not reserve it, confirm its identity, guarantee a price, or create a purchase. Retailer information can change or become unavailable after an item is saved.

You can remove items from Wardrobe. Deleting a scan may remove scan-specific context but may not remove a separately saved Wardrobe product unless the app indicates otherwise. Account deletion removes Wardrobe data as described in the Privacy Policy.

13. Camera, photo library, Share-to-App, and notifications

13.1 Device permissions

Camera, photo-library, file, and notification access depend on your device and operating-system settings. ModaScout requests only the permissions needed for the feature you choose. You can deny or revoke permissions, but the related feature may not work.

13.2 Share-to-App

Supported iOS and Android share features let you send images from another app to ModaScout. The source app and operating system may apply their own terms and may include additional data in the share. You are responsible for checking what you selected before sharing.

Share uploads use deduplication and reconciliation to reduce duplicate captures. Network ambiguity can still delay confirmation. Before retrying an uncertain upload, check the scan list where the app advises you to do so.

13.3 Notifications

Notifications are optional and may be delayed, duplicated, suppressed, or delivered to a device preview depending on Expo, Apple, Google, network, device, permission, and account state. Do not rely on a notification as the sole record that a scan or search completed.

On supported iOS devices, expanded notifications may display garment crops and allow search initiation without opening the app. Protect your lock-screen settings if clothing images or scan information are sensitive.

14. Acceptable use

You must use ModaScout lawfully and fairly. You must not:

We may investigate suspected abuse and take proportionate action, including limiting requests, rejecting content, suspending access, preserving evidence, or reporting unlawful conduct where permitted or required by law.

15. Usage limits and fair access

ModaScout may apply limits to queued captures, selected garments, daily scans, provider calls, searches, retries, upload size, image dimensions, or other resources. Current limits may vary by environment, provider capacity, security risk, or product plan.

Limits protect users, provider budgets, and service reliability. They are not a guarantee that the stated maximum will always be available. We will present a user-friendly message when a user-facing limit is reached.

You must not create multiple accounts or manipulate device identities to evade limits.

16. Intellectual property

The Service, including its software, interface, branding, designs, text, tutorials, selection and arrangement, and non-user content, is owned by or licensed to ModaScout and protected by intellectual-property law.

Subject to these Terms, we give you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the app on devices you own or control for its intended consumer purpose and in accordance with applicable app-store usage rules.

Retailer names, product names, images, trade marks, and other third-party content belong to their respective owners. Displaying them does not imply endorsement, partnership, or ownership by ModaScout.

If you submit feedback, you permit us to use it without restriction or payment, provided we do not publicly identify you without permission.

17. Third-party services

ModaScout depends on third-party services, including Google Gemini, SerpAPI, Google Lens, Google Shopping, Supabase, Render, Expo, Apple, Google, Resend, ExchangeRate-API, retailer sites, and product-image hosts. Their outages, changes, restrictions, errors, or discontinuation may affect the Service.

Your use of third-party websites, stores, devices, networks, and services is subject to their applicable terms. ModaScout is not authorised to grant rights in third-party content beyond those available through the Service.

18. Availability, maintenance, and changes

We aim to provide a dependable Service but do not promise uninterrupted or error-free availability. We may maintain, update, suspend, restrict, or retire features for security, legal, provider, capacity, or product reasons.

We will not make arbitrary changes that unfairly remove consumer rights. For material changes that disadvantage existing users, we will give reasonable notice where practicable and where required by law. Security fixes, legal compliance changes, and urgent provider changes may take effect sooner.

The Service is free at launch and has no subscriptions, paid features, credits, in-app purchases, referral rewards, or paid promotions. If we introduce them, we will show the price, renewal, cancellation, refund, and additional terms before you buy. App-store payment terms may also apply.

ModaScout’s public launch includes the European Union and European Economic Area, alongside other countries and territories selected in the relevant app store. Availability in each country depends on applicable law, app-store availability, provider coverage, and completion of the required privacy and operational arrangements. We may change availability to comply with law, provider coverage, sanctions, app-store requirements, or operational capacity.

19. Marketing communications

If you create a registered account, you may be offered a separate unticked choice to receive ModaScout marketing email. Marketing consent is optional and is not required to create an account or use the Service.

You can withdraw that choice at any time through ME, an unsubscribe link in a marketing email, or by contacting us. We may still send non-marketing messages reasonably necessary for authentication, account security, support, deletion requests, legal notices, or operation of a feature you requested.

20. Suspension and termination

You may stop using the Service at any time and may request account deletion where available.

We may suspend or terminate access where reasonably necessary because:

Where appropriate, we will give notice and an opportunity to correct the issue. We may act immediately where delay would create material risk. Termination does not remove rights or liabilities that arose before termination. Sections intended by their nature to survive, including ownership, retailer responsibility, liability, disputes, and app-store terms, continue to apply.

21. Responsibility when something goes wrong

21.1 Your statutory rights

Nothing in these Terms excludes or limits rights or remedies that applicable consumer law does not allow us to exclude or limit. The Service will be provided with the care and skill required by law.

21.2 Loss we are responsible for

If we breach these Terms, we are responsible for loss or damage that is a foreseeable result of that breach or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious or both you and we knew it might happen when you accepted these Terms.

21.3 Loss we are not responsible for

To the extent permitted by law, we are not responsible for:

We do not exclude or limit responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, or any other liability that cannot legally be excluded or limited.

21.4 Backups and data loss

The Service is not a permanent photo-storage or product-record service. Keep your own copy of any image or information you need. We use reliability and recovery controls, but deletion, account loss, provider failure, or technical faults may make content unavailable.

22. Privacy

Our Privacy Policy explains how personal information is handled and forms part of the information you receive when using the Service. If these Terms and the Privacy Policy appear inconsistent about personal-information processing, the Privacy Policy applies to that processing unless applicable law requires otherwise.

23. Changes to these Terms

We may update these Terms to reflect changes to the Service, providers, law, security, or business. We will update the Last updated date and provide additional notice where required.

If a material change requires your agreement, we may ask you to accept the revised Terms before continuing. If you do not agree, you may stop using the Service and request deletion. Changes do not remove rights or liabilities that already arose.

24. App-store terms

24.1 Apple App Store

If you download or use ModaScout through Apple's App Store:

Nothing in this section gives Apple responsibility that applicable law does not impose on Apple or limits the operator's responsibility beyond what law permits.

24.2 Google Play and other stores

If you obtain ModaScout through Google Play or another store, the store is not a party to these Terms unless its own terms say otherwise. The store's download, licence, payment, refund, device, and account rules also apply. The ModaScout operator remains responsible for the Service to the extent required by law.

25. Export controls and sanctions

You must not use, export, or re-export the Service in violation of applicable export-control, sanctions, or trade laws. You confirm that you are not prohibited from receiving the Service under laws applicable to you or the operator.

26. Governing law and disputes

These Terms and any non-contractual dispute arising from them are governed by the laws of England and Wales.

If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you live. You may bring a claim in any court that applicable consumer law permits, including the courts of your home country where required. The operator may also bring a claim in a court permitted by applicable law.

Before starting formal proceedings, please contact support and provide enough information for us to investigate. We are not currently a member of a consumer ombudsman or alternative dispute-resolution scheme. Nothing in this section prevents either party seeking urgent relief or using a regulator, small-claims procedure, chargeback right, or other remedy available by law.
